BPJS Ketenagakerjaan vs Private Insurance: Which Is Better for Employers?

BPJS Ketenagakerjaan and private insurance are not alternatives. BPJS Ketenagakerjaan, together with BPJS Kesehatan, is compulsory for every employer in Indonesia, including for foreign employees working at least six months. Private insurance is voluntary and supplementary: it adds higher limits, wider hospital networks and international cover.

Is BPJS a form of insurance?

BPJS is a statutory social security administrator, not a commercial insurer. Both pool contributions against risk, but their legal basis, membership rules and benefit design are fundamentally different.

Under Article 14 of Law No. 24 of 2011, every person, including foreigners working in Indonesia for at least six months, must participate. There are two bodies:

  • BPJS Ketenagakerjaan runs Work Accident (JKK), Death (JKM), Old-Age Savings (JHT), Pension (JP) and Job Loss (JKP) programmes.
  • BPJS Kesehatan runs the National Health Insurance scheme (JKN).

Private insurance, by contrast, is a contract with a licensed insurer supervised by OJK, the financial services authority, on terms set by the policy wording. An employer may choose whether to buy private cover; it cannot choose to skip BPJS.

What does an employer contribute to BPJS in 2026?

For salaried employees, BPJS Ketenagakerjaan and BPJS Kesehatan contributions are a percentage of monthly wages, shared between employer and employee as set out below.

ProgrammeEmployerEmployeeNotes
JKK (work accident)0.24%–1.74%–Depends on risk class; office work is normally 0.24%
JKM (death)0.30%–Paid entirely by the employer
JHT (old-age savings)3.7%2%5.7% of wages in total
JP (pension)2%1%Wage base capped at IDR 11,086,300 from March 2026
JKP (job loss)No additional contribution–0.36%: 0.22% from central government and 0.14% reallocated from JKK
JKN (BPJS Kesehatan)4%1%Wage base capped at IDR 12,000,000

Rate sources: the BPJS Ketenagakerjaan contribution page, Government Regulation 6 of 2025 on JKP and Presidential Regulation 64 of 2020 for JKN. The JP wage cap is indexed each year to GDP growth, so payroll parameters need an annual update. Watch for implementing rules on the standard inpatient class (KRIS), which may affect the JKN contribution model.

Example: for an Indonesian office employee earning IDR 15,000,000 a month, the employer's cost is about IDR 1,337,726 (JKK 36,000, JKM 45,000, JHT 555,000, JP 221,726, JKN 480,000), while the employee's payroll deduction is about IDR 530,863 (JHT 300,000, JP 110,863, JKN 120,000).

How does BPJS Ketenagakerjaan differ from private insurance?

They differ in whether cover is compulsory, how contributions are set and how flexible benefits are: BPJS is one national baseline, a private policy is tailored.

For most employers the real decision is how to layer private cover over BPJS: JKN as the base, with group health insurance for room class and outpatient care; JKK and JKM as the base, with term life and personal accident cover for key staff. Article 51 of Presidential Regulation 82 of 2018 expressly allows JKN members to upgrade beyond their entitlement, including executive outpatient care, through supplementary health insurance, so the two layers can work together.

What are a PT PMA's obligations for foreign employees?

Foreign employees working at least six months must be registered, but not every programme applies to them. According to the official BPJS Ketenagakerjaan FAQ, foreign nationals cannot join JP or JKP.

For expatriates holding a work KITAS, the company registers JKK, JKM and JHT with BPJS Ketenagakerjaan and JKN with BPJS Kesehatan, using a passport copy and the registration form. On the same IDR 15,000,000 salary, the employer's cost falls to about IDR 1,116,000 and the employee's deduction to about IDR 420,000, because there is no JP contribution.

International health cover arranged by head office does not remove the JKN obligation. New PT PMAs often discover this shortfall only during a BPJS inspection or a licensing application. For wider obligations, see our guide to foreign companies in Indonesia.

How are BPJS contributions and private premiums taxed?

Employer-paid JKK, JKM and JKN contributions and employer-paid insurance premiums are added to the employee's gross income for Article 21 income tax (PPh 21).

This follows Minister of Finance Regulation (PMK) 168 of 2023, as explained by the Directorate General of Taxes. In summary:

  • Added to gross income: employer-paid JKK, JKM, the 4% JKN share and company-paid health, accident, life, endowment and scholarship premiums.
  • Deductible from gross income: the employee's own JHT and JP contributions.
  • Not deductible: the employee's 1% JKN share and personal premiums.
  • For the company: premiums incurred to earn, collect and maintain income are deductible.

Adding private cover therefore increases each employee's PPh 21, which matters under a tax gross-up policy. Reconciling payroll, BPJS reports and monthly PPh 21 returns also feeds into filing individual tax returns in Indonesia.

What happens if an employer does not comply?

Exposure escalates from late-payment surcharges to licence-blocking administrative sanctions and, for unremitted deductions, criminal liability.

Late BPJS Ketenagakerjaan payment (due by the 15th of the following month)Surcharge of 2% for each month of delayGovernment Regulations 44, 45 and 46 of 2015

Failure to collect or pay over contributionsImprisonment of up to 8 years or a fine of up to IDR 1 billionLaw 24/2011 Art. 55

An unregistered employee's workplace accident also leaves the company carrying costs JKK would have covered.

How should employers structure an efficient benefits package?

Start with accurate BPJS compliance, then add private insurance only for genuine gaps.

  1. Map membership by employee, nationality and required programme.
  2. Check the wage base reported to BPJS against payroll; under-reporting cuts benefits and creates audit findings.
  3. Identify benefit gaps, especially outpatient care, room class and cover abroad.
  4. Choose supplementary policies: group health, term life or a supplementary pension plan.
  5. Model the PPh 21 impact before approving the package.
  6. Keep records: receipts, membership certificates and monthly reconciliations.

JCSS Indonesia reviews BPJS and PPh 21 compliance as part of its tax compliance and audit readiness service. For background on the tax authority itself, read the Directorate General of Taxes in Indonesia.

Frequently asked questions

Can a company replace BPJS with private insurance?

No. Law 24 of 2011 requires every employer to register its employees with BPJS Ketenagakerjaan and BPJS Kesehatan; private insurance can only be an addition. A company offering only a private policy can face administrative sanctions, including withdrawal of certain licensing services, and must settle unpaid contributions with late-payment surcharges.

Do foreign employees have to join BPJS?

Yes, if they work in Indonesia for at least six months. Foreign employees are registered for JKK, JKM and JHT with BPJS Ketenagakerjaan and for JKN with BPJS Kesehatan. According to BPJS Ketenagakerjaan, foreign nationals cannot join the Pension (JP) or Job Loss (JKP) programmes. International health cover from head office does not replace JKN.

How much does an employer pay in BPJS contributions in total?

For an Indonesian employee in the very-low-risk class, the employer pays 0.24% JKK, 0.30% JKM, 3.7% JHT, 2% JP and 4% JKN, roughly 10.24% of wages before caps. The JP wage base is capped at IDR 11,086,300 from March 2026, and the JKN wage base is capped at IDR 12,000,000.

Are employer-paid private insurance premiums subject to PPh 21?

Yes. Health, accident, life, endowment and scholarship premiums paid by the employer are added to the employee's gross income and taxed under PPh 21. The same applies to the employer's share of JKK, JKM and JKN. For the company, these premiums are generally deductible as a business expense.

What is the penalty for paying BPJS Ketenagakerjaan contributions late?

Contributions are due by the 15th of the following month. Late payment attracts a 2% surcharge on the overdue amount per month of delay, borne by the employer. Not paying over contributions deducted from wages can, under Article 55 of Law 24 of 2011, lead to up to 8 years' imprisonment or a fine of up to IDR 1 billion.
